1. About these Terms
These Terms & Conditions (“Terms”) govern your use of the MorayCare Jobs website (the “Site”) operated by Nightingale Home Support Ltd (“we”, “us”, “our”). By accessing the Site, submitting a vacancy, or adding a candidate profile, you agree to these Terms.
2. The Service
MorayCare Jobs is a local online directory and job board for the care sector in Moray, Grampian and the Highlands. We:
- Publish anonymised candidate previews (with consent) to help employers find local talent.
- Allow employers to post care and health vacancies for a fee.
- Facilitate introductions between employers and candidates only after manual review and explicit consent.
Important: We are not a recruitment agency. We do not guarantee job offers, candidate suitability, or successful placements. All employment decisions are made solely by the employer and candidate.
3. Posting a Vacancy (Employers)
- You must provide accurate, truthful information about the role, organisation, and requirements.
- Listings are active for 30 days from going live (or until filled/removed by us).
- Pricing: From £49 per vacancy (packages available). Payment is arranged via email after form submission. We reserve the right to refuse or remove any listing that breaches these Terms or is inappropriate.
- Featured listings (+£25) receive priority placement and a badge.
- You are responsible for the content of your job advert and for complying with all applicable employment and equality laws.
4. Candidate Profiles
- When you submit a profile, only an anonymised preview is shown publicly (initials, job title, location, skills, summary).
- Your full name, contact details and CV are stored securely and released only with your explicit consent to a verified employer making a genuine request.
- You may request removal or update of your profile at any time by emailing us.
- By submitting, you confirm you are actively seeking work in the care sector in the stated area and consent to us contacting you about suitable opportunities.
5. User Conduct
You agree not to:
- Post false, misleading, discriminatory or illegal content.
- Use the Site for any purpose other than legitimate care-sector recruitment.
- Attempt to scrape, copy or misuse candidate or employer data.
- Impersonate any person or organisation.
6. Intellectual Property
All content on the Site (text, design, logos, job listings where applicable) is owned by us or our licensors. You may not copy, reproduce or distribute any part of the Site without prior written permission, except for personal non-commercial use or sharing individual job links.
7. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any loss or damage arising from your use of the Site, inability to find work/staff, or any employment relationship formed via the Site.
- We do not guarantee the accuracy of job descriptions or candidate summaries (these are provided by users).
- Our total liability in connection with the Site shall not exceed the fees paid by you in the 12 months preceding any claim.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by law.
8. Payments & Refunds
Payment for vacancy listings is due after we confirm your submission. Refunds are at our sole discretion and only considered if we fail to publish your listing within the stated timeframe due to our error. No refunds for change of mind once the listing has gone live.
9. Privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.
10. Changes to these Terms
We may update these Terms occasionally. Continued use of the Site after changes constitutes acceptance of the new Terms. The current version is always available on this page.
11. Governing Law
These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
